Definitions

In these terms and conditions, the following words and expressions have the following meaning unless otherwise stated:

"website" means the URL www.indialets.com;

"you" and "your" means any and all persons using this website, including but not limited to travellers and homeowners.

"we", "us" and "our" means Indialets Ltd trading as Indialets.com

"property owner(s)" and "home owner(s)" means the party(ies) who are legally responsible for the property advertised with us. This may be the individual owner(s) of the property, the developer or agent acting on behalf of the property owner.

"traveller" and "holidaymaker" means the user who is or has entered contact with the property owner to rent their property for an agreed period of time and fee using our website.

"property(ies)" and "holiday home(s)" means the individual or collective properties advertised by a property owner on our website for letting.

"material" means the content of this website including but not limited to user submitted information such as photographs, images, written content in relation to any particular property advertised on our website.

General Terms of Use

These terms and conditions govern your use of our website; by using our website, you accept these terms and conditions in full. If you disagree with these terms and conditions or any part of these terms and conditions, you please do not use our website.

This applies to all users of our website www.indialets.com, including but not limited to advertisers and travellers.

About the website

This website exists solely as an advertising portal providing an accommodation search facility for holidaymakers travelling to India. All properties listed are to allow property owners to receive enquiries and confirm bookings of their property for a letting period between the property owner and interested party(ies) concerned. We have no involvement in the booking process or any communication between the property owner and person(s) whom have made the enquiry. We are not the property owner or agent and we do not make any claims to the quality, safety or legality of the properties advertised, including the accuracy of their content. We have no responsibility for breach of contract, negligence, misinterpretation or other faults in relation to each advert; this responsibility lies solely with the property owner(s). It is the responsibility for the property owner to ensure the home is eligible for letting and that the responsibility of the holidaymaker to ensure the rent is paid. We do not have any involvement in this matter.

 

Website material & Intellectual Property

All published material on the website in relation to a property advert is the sole responsibility and provided by the property owner. We do not check this material and cannot confirm the accuracy of the description thereby make no warranty as to the information represented in relation to any laws, health and safety or quality issues which may arise. All copyright, trade mark, database rights and design in our website belong to us.

License to use website

Unless otherwise stated, we or our licensors own the intellectual property rights in the website and material on the website. Subject to the licence below, all these intellectual property rights are reserved.

In relation to advertisers, you warrant that you are at least 18 years old and are financially responsible for all charges in relation to your use of this website.

You may view, download and print pages from the website for your own personal use for the purpose of researching/sending on and/or making a holiday rental booking for yourself, family or friends.

You must not:

a) Republish any material from this website (including republication on another website);

b) Sell, rent or sub-license material from the website;

c) Display any material from the website in public;

d) Reproduce, duplicate, copy or otherwise exploit material on our website for a commercial purpose;]

e) Edit or otherwise modify any material on the website; or]

f) Redistribute material from this website except for content specifically and expressly made available for redistribution, such as our newsletter.

Any breach in these terms may cause us to terminate your license to use our website. You also agree to indemnify us for all claims, liabilities, damages or incurred costs and any related sums which may result in your breach of these terms.

Acceptable use

You must not use our website in any way that causes, or may cause, damage to the website or impairment of the availability or accessibility of the website; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.

You must not use our website to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software.

Terms applicable to property advertisers only

Payment and renewal

No advertisements will be activated unless payment has been made. To advertise your property your payment is made through our website using our PayPal ^TM account. There are alternative methods of payment available such as bank transfer if required. A bank transfer incurs a administration charge of £10 for the bank charges incurred.

Subject to these terms advertisements are paid on an annual basis, a subscription. Subscription fees are non refundable. Adverts are automatically renewed at the expiry of the advert period where a debit payment will be made for the following 12 months unless you advise us by email prior to the expiry date that you do not wish to renew your advert. Failure to notify us will not invalidate the auto-renewal of your advert. You will be notified prior to the expiry by Indialets but the sole responsibility to cancel the renewal lies with the advertiser.

In respect of the automated renewal, you may cancel and request a refund for any auto-renewal providing you notify us by email at least 7 days after the payment has been deducted. After this period no refund will be possible.

We reserve the right to change the advertiser rates and conditions without any notice. All new and existing advertisers will be immediately applicable for any new rates introduced through new advertisements and renewals.

 

User generated content

As the advertiser, you confirm that all the material you post on the website represents fairly, accurate and up to date information regarding the property(ies) to which it relates and in any respect is not misleading. Your user content will include but not limited to images, videos and descriptive material in relation to the specific property(ies). You confirm that all material posted in your advert is suitable and does not breach and is compliance with all applicable and /or legal requirements and does not infringe on any third party rights. In addition, you confirm that all material posted is of your own intellectual property or you have written permission of the owner of the copyright or intellectual property. It is your sole responsibility to update all material when required. All material posted on our site grants us worldwide, irrevocable, non-exclusive and royalty-free right to display and reproduce any user content in relation to advertising the property we see appropriate.

We reserve the right, without prior notice, to modify or remove any material hosted on our website we consider inappropriate at our own discretion.

As the advertiser, you confirm that you are legally entitled and have full legal authority to enter into contract with any person(s) wishing to book the property for rental purposes. Contracts for the rental of the property are conducted solely between the advertiser and the person(s) who have made the booking to which we do not have any involvement. We are entitled to require you to produce appropriate proof of your identity and ownership or right to represent the owner in respect to the property.

Termination of advertisement

With immediate effect, we are entitled to terminate any property advertisement following a notice in writing to the owner, including email, in the event:

a) Of any material posted on the website is in breach of the terms and conditions in relation to advertising of the property on the website

b) repeated breach of the terms and conditions in relation to advertising of the property on the website

c) that the owner can no longer legally advertise the property for rental purposes, such as bankruptcy or insolvency.

In the event of any such circumstance, we hold no liability and no refund in relation to the terminated subscription is permitted.

Claims, indemnity and our liability

All contracts for rental of any advertised property on our site are agreed between the property owner and holidaymaker. We do not have any involvement in the rental contracts between the two parties. In relation to this, you confirm that any claim you may have that is connected with a dispute you may have with the property owner or the holidaymaker, as users or our site, must be brought directly to the specific user and not against us. You also agree to compensate us for any claims, costs or expenses (including but not limited to legal costs), losses or damages incurred by us as a result of any claims made against us by a user on our site (or third party representative) in relation to your transactions with users on our side including:

a) Incorrect, inaccurate, misleading or fraudulent information in the material posted on the advert

b) A breach in contract agreed between the property owner and holidaymaker

c) Any loss or damage incurred at the property

d) Any incident such as personal injury, or act of negligence which occurred at the property

We are not liable for:

a) any loss or damage incurred at the property including but not limited to, damage to the property or an incident which has occurred at the property

b) any loss incurred by the property owner or holidaymaker being in breach of the user agreed contact

c) any loss or damage incurred by any user in connection with our website through use, the inability to use or results of use of the website, any websites linked to it and material posted on the site. This includes but is not limited to:

I. loss of income or revenue

II. loss of business

III. loss of data

IV. loss of goodwill
